The Site is offered to you (hereinafter referred to as "you" or "user") on the condition that you accept all these Terms of Use, therefore we strongly encourage you to review these terms of use before using the site as they will affect your rights in connection with use of the site. The content of the Furry Fable site is intended for entertainment purposes only.

By accessing, browsing or using the Site, you signify your agreement to these terms of use and agree to be legally bound by these terms of use. If you do not agree to these terms of use, please discontinue use of the site immediately. Any violation of these Terms of Use may result in termination of your account or other restricted access to the site, at our sole discretion.

If you are a parent or guardian and have provided your consent to your child's registration with the site, we will assume (and by using this site you warrant that) you have the legal capacity to agree to these terms of use and agree to be bound by the terms of use in respect to you and your child's use of the site.

Nothing in these terms of use shall have the effect of transferring the ownership of any trademarks, service marks, trade names or other proprietary rights in the Site to you or any third party.

The Site is for your personal use only. You agree not to use the site for commercial purposes or in any way that is unlawful, or harms us or any other person or entity, as determined in our sole discretion.

All information, materials, and content contained on the site are copyrighted property or the copyrighted property of our licensors or licensees. You agree not to reproduce, distribute, or transmit any material used on the site. Furry Fable grants you a personal, non-exclusive, non-assignable and non-transferable license to view material on the site on a single computer for your personal, noncommercial home use only, provided that you maintain all copyright and other proprietary notices. Further, you agree not to sell, download, remove, reproduce, modify, perform, publish, disseminate, reverse-engineer, decompile or disassemble any materials found on the site to any third party without the express prior written consent of Furry Fable. You agree that you will not make any modifications to or create any derivative works based on the site or its content, in whole or in part, nor use the site or its content and materials in a way that suggests an association with Furry Fable or Sentinel Media Group LLC.

Should we allow the download of any software from the site, all files, images and other data associated with or generated by such software is licensed to you by us for your personal, non-commercial use only. All such software remains the sole property of Furry Fable and/or its third-party licensors. You agree not to sell, download, remove, reproduce, modify, perform, publish, disseminate, reverse-engineer, decompile or disassemble any downloaded software and its associated data and images from the site to any third party without the express prior written consent of Furry Fable. You agree that you will not make any modifications to or create any derivative works of any downloaded software and its associated data and images based on the site or its content, in whole or in part, nor use said material in a way that suggests an association with Furry Fable or Sentinel Media Group LLC.

3. REGISTRATION AND ACCOUNTS
To access and use the site or some of the materials available hereon, you may be required to create an account (or "register") with us. When you create an account, this allows access and participation of additional benefits on the site. If you register a Furry Fable account, you agree to provide, maintain and update true, accurate, current and complete information about yourself as prompted by our registration processes. We have the right to terminate you account if we believe you have misrepresented your identity including using another person's username, password or other account information. You are responsible for maintaining the confidentiality of your account information and agree to take responsibility for any unauthorized use of such information. Should you discover any unauthorized use of your username, password, or other account information, you agree to immediately notify Furry Fable of such unauthorized use.

Subject to applicable law, we may suspend or terminate your account and your ability to access the site or portion thereof for failure to comply with these terms of use or any special terms related to a particular service, for infringing copyright, or for any other reason whatsoever.

4. USER SUBMISSIONS
"User Submissions" shall mean any information that you transmit or otherwise provide to the site. These submissions include, but are not limited to ideas, stories, artwork, photographs, concepts, drawings, videos, musical compositions, lyrics, sound recordings, text, suggestions and/or any other information that you post, submit, display, communicate or otherwise distribute on or through the site or an affiliated site. By uploading or otherwise submitting any information to us and/or the site, you (and your parent/legal guardian(s) if you are under 18) grant (or warrant that the owner of such rights has expressly granted) to Furry Fable a perpetual, royalty-free, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials into any form, medium or technology throughout the world. We reserve the right to contact you for further information regarding any submission made. Furry Fable can use any submission for any and all purposes without further notice to you, with or without attribution, and without the requirement of any permission from or payment to you or to any other person or entity.

Do not distribute any unsolicited user submissions. You agree that any submission you make is not being made in confidence and there is no expectation of confidentiality and no fiduciary relationship is created between you and us in any way. Further, you will have no expectation of any review, compensation or consideration of any type for said submission.

Furry Fable, its subsidiaries, assigns, affiliated companies, licensors and/or other agents shall be entitled to exploit and disclose any and all submissions and you agree to indemnify and hold harmless Furry Fable, its subsidiaries, assigns, affiliated companies, licensors and/or other agents should any person or entity claim ownership of such submissions.

To the extent any "moral rights," or other similar rights recognized throughout the world exist in connection with any submissions, you agree that these rights are waived unconditionally and you will not attempt to enforce any such rights under applicable law as to us, our licensees, distributors, agents, representatives and other authorized users, and you shall procure the same agreement not to enforce from any others who may possess such rights. Waiver of moral rights shall be undertaken to the maximum extent allowed by law.

5. IN-GAME COMMUNICATION
Furry Fable offers its users the ability to chat within a chat area on the game interface and also via "instant messenger" within the game to other players. You acknowledge that these in-game communications are public and not private communications and you have no expectation of privacy with regard to any submission you make in the chat area or within instant messages. Any disclosures you make in these mediums are made at your own risk. You are solely responsible for any communications made in the game with your username and accept the consequences of any messages, in particular those that violate these terms. We are not responsible for and do not endorse any chat or other messages from any users of the site and disclaim any and all liability in connection therewith. We reserve the right to remove or edit any in-game communications that users may make for any reason at our sole discretion.

6. RULES OF CONDUCT
By using the Furry Fable site, you agree to the following:
a. You will not create a user name or use the chat and/or messaging functions that is defamatory, abusive, harassing, an invasion of a right of privacy of another person, bigoted, hateful, racially offensive, violent, vulgar, obscene, sexually explicit; or could otherwise be harmful to someone;
b. You will not create a username that includes your real name or location, nor a derivative of your real name and/or location;
c. You will not do or discuss anything that is illegal or encourages or advocates illegal activity;
d. You will not attempt to cheat the game nor try to circumvent the security measures we have in place;
e. You will not ask for, nor try to obtain someone else's password or other account information;
f. You will not do or discuss anything that infringes upon or violates a copyright, trademark, or other confidential information;
g. You will never give out any of your (or anyone's) personal information, including but not limited to names, addresses, email addresses, social network IDs, Instant Messenger IDs, telephone numbers, etc.;
h. You will not discuss anything that is commercial or business-related that offers to sell any products or services;
i. You will not tamper with, impair or damage the site or any of its connected networks that would interfere with anyone's use or enjoyment of the site; or
j. Anything else that is disruptive in a public chat including, but not limited to spamming, greifing, flaming and trolling.

Furry Fable reserves the right to monitor all actions on the site. However, we cannot guarantee that other users will always comply with the Rules of Conduct and other terms of use, and therefore, you assume all risk of harm that may result from any user(s) lack of compliance with our Rules of Conduct.

7. INDEMNIFICATION
You are solely responsible for all activities that occur under any and all accounts you have with Furry Fable. You agree to be solely responsible for maintaining the confidentiality of your username(s), password(s), and your account(s).

You hereby agree to indemnify, defend, and hold harmless Furry Fable, Sentinel Media Group LLC, and their respective officers, directors, employees, agents, licensors, licensees, distributors, representatives, third-party providers to the site as well as any other authorized users from and against any and all losses, expenses, damages, liabilities and costs (including any costs associated with legal action or expenses for investigating or defending any actions or threatened actions) in connection with any claim arising out of any breach by you of these terms of use or claims arising from your use of the site and/or your account(s). You will use your best efforts to cooperate with us in the defense of any claims against us. We reserve the right to assume, at our own expense, the exclusive defense and control of any matter, otherwise subject to indemnification by you, whereupon you will fully cooperate with us in the defense of any claims against us.

8. DISCLAIMERS
SUBJECT TO APPLICABLE LAW, THE SITE AND ALL MATERIALS CONTAINED ON IT ARE PROVIDED, DISTRIBUTED AND TRANSMITTED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT CONDITIONS, REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS, STATUTORY OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, FURRY FABLE DISCLAIMS ALL WARRANTIES, EXPRESS, STATUTORY OR IMPLIED, INCLUDING, SUBJECT TO APPLICABLE LAW, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, SECURITY, AND NONINFRINGEMENT. FURRY FABLE DOES NOT WARRANT THAT ACCESS TO ITS CONTENT WILL BE AVAILABLE, ERROR-FREE, AND UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE ITS CONTENT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. FURRY FABLE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF ANY CONTENT. NOR THE CONTENT IN ANY SITES THAT ARE LINKED TO THE SITE IN CONNECTION WITH THEIR ACCURACY OR RELIABILITY. YOU WAIVE ANY CLAIM AGAINST US REGARDING ANY CONTENT (SUCH AS CREDIT CARD AND OTHER PERSONAL INFORMATION) THAT YOU PROVIDE TO THIRD PARTY SITES.FURRY FABLE IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER OF ITS SITE AND YOU USE THE SITE AT YOUR OWN RISK AND YOU ARE RESPONSIBLE FOR COMPLIANCE WITH ALL APPLICABLE LAWS. FURRY FABLE MAKES NO REPRESENTATION THAT ITS CONTENT IS APPROPRIATE OR AVAILABLE FOR USE IN ANY PARTICULAR LOCATION.

9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT UNDER APPLICABLE LAW, UNDER NO CIRCUMSTANCES, UNDER ANY LEGAL THEORY, SHALL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, REPRESENTATIVES, AND THIRD-PARTY PROVIDERS, BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, COMPENSATORY, SPECIAL OR CONSEQUENTIAL DAMAGES AND PROPERTY DAMAGE OF ANY NATURE WHATSOEVER, THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THIS SITE OR THE MATERIALS CONTAINED ON THIS SITE WHETHER THE MATERIAL IS PROVIDED OR OTHERWISE SUPPLIED BY FURRY FABLE OR ANY THIRD PARTY, NOR SHALL WE BE LIABLE TO YOU OR ANYONE UNDER ANY LEGAL THEORY FOR ANY OF THE ABOVE-MENTIONED DAMAGES THAT RESULT FROM THE CONDUCT OR ACTIONS OF ANY USER OF THE FURRY FABLE SITE, EVEN IF WE HAVE BEEN NOTIFIED OF THE POSSIBILITY OF SAID DAMAGES. NOTHWITHSTANDING THE FOREGOING, IN NO EVENT SHALL FURRY FABLE'S LIABILITY TO YOU FOR ANY AND ALL CLAIMS, DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU TO ACCESS THIS SITE OR ITS MATERIALS. WE RESERVE THE RIGHT TO ALTER OR DELETE THE CONTENT ON FURRY FABLE AT ANY TIME IN OUR SOLE DISCRETION WITHOUT LIABILITY.

10. VENUE
This Site is controlled and operated by Furry Fable from its offices in Greenville, South Carolina in the United States of America and you agree that these terms of use shall be governed by and enforced in accordance with the laws of the State of South Carolina. Should any action brought by you, Furry Fable or a third party in connection with any matters related to the site, you hereby consent and submit to the personal jurisdiction of either the Federal or State Courts located in Greenville County, South Carolina.

11. COPYRIGHT POLICY
If you believe that the site contains any content that infringes upon your intellectual property rights, written notice of the alleged infringement must be sent to the following department:

A physical or electronic signature of a person authorized to act in behalf of the complaining party; and A statement, under penalty of perjury, that the person issuing the claim of copyright infringement is authorized to act on behalf of the owner of the work and that the information in the notice is accurate.

12. MISCELLANEOUS
If any provision of these terms of use shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions. The failure or Furry Fable to exercise, assert or enforce any right or provision under these terms of use shall not constitute a waiver of such right or provision.

We may be required to notify you of certain events, including whether there are changes to the site or its terms and conditions. You agree that such notices become effective upon our posting them on the site or upon notifying you by email or postal service. We are not liable for any failure to notify you due to your failure to provide accurate and updated information.

No software from this site may be downloaded or exported in violation of any law of any foreign countries that are subject to United States export restrictions.

Any links to other websites that may occur on the site are provided solely as a convenience to you and are provided on an "as is" basis, without any warranties of any kind, either express or implied. Furry Fable has no control over such websites and does not endorse their content, products or services. Furry Fable also cautions you of the risks inherent in visiting any website. You take full responsibility for your use of such sites. To the fullest extent possible by law, Furry Fable disclaims all warranties, express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Users of Furry Fable may sign up for a 1-month, 6-month or 1 year membership term. Memberships will automatically renew at the end of each term unless you specifically cancel the membership. To cancel membership, you may access your account on the site to cancel or you may contact our support staff for assistance. All membership fees already paid are non-refundable.

Furry Fable strictly complies with the terms of the Children's Online Privacy Protection Act (COPPA). Please review our Privacy Policy, which is incorporated into these terms of use as if set forth herein. These terms of use contain the entire agreement between you and Furry Fable relating to the use of the site and its content. These terms of use shall be deemed to include all other notices, policies, disclaimers and other terms contained on the site, however should there be a conflict between these terms of use and other terms on the site, these terms of use shall control.

These terms of use are not assignable, transferable or licensable by you except with Furry Fable's express written consent.

Sentinel Media Group LLC shall be entitled to terminate this agreement and immediately remove, cancel or suspend access to and use of the Furry Fable site for any reason, including but not limited to your violation of any of these terms, sale of Furry Fable to another company, or for any other reason in our sole discretion and without notification.
